Mistreatment in a nursing home can occur in a number of forms. It sometimes occurs through nursing malpractice, for example where a resident dies from sepsis because nurses failed to detect and treat a decubitus ulcer. It sometimes occurs in the form of physical abuse, such as beatings, rape, or sexual assault. Emotional mistreatment and neglect of a resident also constitute unlawful mistreatment.
Family members of a nursing home resident should watch diligently for any signs of abuse, neglect, or substandard care. Visits should be frequent and unannounced, and observations compared between visits. A designated family member should ask questions of the nursing staff about how the resident is doing. Alarm bells should sound if a caregiver responds defensively, indifferently, or otherwise suspiciously to reasonable questions. Be attentive to conflicting stories from your loved one and the caregiver.
